Expert Opinion in International Arbitration and Examination of Expert Witnesses: joint seminar of RGP and KPMG supported by ICC Russia
Rybalkin, Gortsunyan & Partners and KPMG with support from the Russian National Committee of the International Chamber of Commerce – World Business Organization (ICC Russia), will jointly host an online seminar “Expert Opinion in International Arbitration and Examination of Expert Witnesses”. The seminar will be held at 10 am on Wednesday 9 December 2020 via Zoom.

All complex arbitrations require involvement of experts on technical, financial, legal and other issues. The importance of an expert opinion and the role of an expert in resolving a dispute cannot be overestimated as the final outcome of the case might depend on their findings. The correct choice of an expert, liaising with them and expert examination at the hearings undoubtedly lay the foundations for winning a case.

The seminar will highlight various aspects of examination of expert witnesses at arbitration hearings. RGP’s partner and head of Arbitration practice Dmitry Dyakin will open the event with a key note address. Vladimir Pestrikov, a partner at RGP, will talk about expert assessment of damages and will touch upon all key issues of coordination between legal advisers and experts, and senior associate Vsevolod Taraskin will discuss practical aspects of legal expertise and expert examination. Speakers at the seminar intend to demonstrate how lawyers and experts can, through a coordinated effort, secure the client’s victory.

Some of the issues to be discussed include:

how to interact with experts in assessing the quantum of damages: from selecting a potential expert to taking part in the hearings;


a range of economic and forensic expert reports, and which of them might be of use in your dispute;

why a legal expert might be required, the difference between a legal expert and a party’s legal counsel, and specifics of their cross-examination;

how to develop a strategy for a cross-examination of an expert witness in order to undermine their account, and how an expert can survive an examination lasting many hours.
