Vladimir Pestrikov, RGP’s partner in the Dispute Resolution practice, spoke about Appointment of Arbitrazh Receivers: Modern Approaches in Court Practice at the session entitled “Bankruptcy 2020: Positive Signs”.

Vladimir’s report included:

• key statutory and prevailing case law requirements to a court-appointed (“arbitrazh”) receiver;

• criteria of independence of an arbitrazh receiver which developed in the case law during the last few years;

• an overview of landmark 2020 court disputes involving appointment of an arbitrazh receiver.

The audience was especially interested in the manner of appointment of arbitrazh receivers. Vladimir raised this issue asking them to summarise the advantages and disadvantages and express their own views on the most acceptable manner of appointing an arbitrazh receiver.

The Forum was held offline.  As part of the event, the panellists shared their opinions on the most relevant legal matters, discussed the current challenges and issues and tried to suggest a way to overcome them.

The Forum traditionally gathers the leading Russian legal experts and representatives of the State and business community.
