Maria Samartseva, Counsel and Head of IP Litigation Practice at Rybalkin, Gortsunyan, Dyakin & Partners (RGD), participated in the XV International conference for ccTLD registries
and registrars of CIS, Central and Eastern Europe.

The event was dedicated to discussing issues related to the Internet. Annually, it brings together leading ccTDL registrars, legal professionals and cyber security experts.

The topic of Maria Samartseva's speech was the prejudicial termination of the delegation of domain names and the fight against violations in domain zones. Maria shared her general strategy for dealing with disputes, noting that there are two ways to resolve disputes of this kind – judicial and prejudicial. In practice, the fastest and result-oriented way to resolve a dispute is through a prejudicial proceedings, as this helps saving time and resources of the of the complainant. However, Maria noted that the technological base of this issue is improving every day, and lawyers often have to turn to IT specialists to investigate violations of intellectual property rights that have taken place specifically in the past. At the same time this technological base is constantly evolving and allows using a wide range of monitoring tools to detect current and past violations. Today most companies have access to these tools, which enables early detection of violations streamlining the work of complainants’ teams.
