On April 12, 2024, HSE University’s Laboratory of International Justice held a workshop on "Neutrality of Arbitrators in Sanctions Disputes." Vadim Vunukainen, Counsel at the Dispute Resolution Practice of the law firm Rybalkin, Gortsunyan, Dyakin and Partners (RGD), took part in the event.
The participants discussed the current approaches to neutrality and the existing requirements for arbitrators given the present geopolitical situation. They also talked about challenges to arbitrators in the following cases: participation in international political organizations, public statements reflecting one’s explicit political position, and posts on social networks.
The participants also expressed their opinions on whether arbitrators who are citizens of countries supporting the sanctions can be neutral, especially in disputes related to the application of such sanctions.
