On February 29, Moscow hosted a conference titled “Legal Practice — 2023–2024: Key Cases”, which was organized by a leading Russian legal website, pravo.ru. The event brought together the legal community to discuss the most high-profile cases of the last 12 months.
The second session, “Compilation of the Best Legal Moments of the Year”, was attended by Yuri Makhonin, Partner of Dispute Resolution Practice at Rybalkin, Gortsunyan, Dyakin and Partners (RGD). He spoke about a case in which Russian courts reviewed rulings on recognition and enforcement of an international arbitration award after a district court in Saint Petersburg delivered a verdict against witnesses who had testified in the international arbitration proceeding.
Yuri focused on the legal implications of the case, emphasizing that in order for a ruling on recognition and enforcement of an international arbitration award to be reviewed, it does not matter whether the legal person was found guilty of tampering with evidence or giving intentionally false testimony as a witness. For Russian courts, it is enough to prove that the wrongdoing resulted in an unlawful or unreasonable arbitration award.
In addition, Yuri took part in the event’s fourth session, a debate on the topic “Should Russian Clients Litigate Abroad in the Current Geopolitical Environment?” The debate discussed the limitations and conditions for applying Article 248.1 of the Commercial Procedure Code of the Russian Federation by Russian courts.
