Yuri Makhonin, Partner at Dispute Resolution Practice, Rybalkin, Gortsunyan, Dyakin and Partners (RGD), spoke at a webinar titled “Disputes involving sanctioned parties: Russian courts or international arbitration,” at which he discussed the latest issues with regards to resolving international commercial disputes. The webinar took place on October 19 and attracted more than 80 listeners. The event was organized by Technologies of Trust.

At the webinar, Yuri spoke about the main advantages of international arbitration and examined the obstacles posed to it by Article 248.1 and 248.2 of the Arbitration Procedure Code of the Russian Federation. Using examples from the practice of the courts of England and Wales and the High Court of Hong Kong, Yuri showed how anti-suit injunctions influence proceedings in international arbitration.

Also, the speaker dwelled on the effect of sanctions, explaining how they have affected the arbitration procedure and how various international arbitration centers handle sanctions disputes. Based on these observations, Yuri identified several dispute resolution trends in arbitration involving Russian parties.

In conclusion, he shared tips and recommendations on what measures should be taken when entering into a contract and formulating an arbitration clause, as well as at the beginning of arbitration proceedings.
