The Rybalkin, Gortsunyan, Dyakin and Partners (RGD) law firm sponsored the Istanbul Arbitration Week (ISTAW), an annual legal forum which took place from October 2 to October 6, 2023.

Yuri Makhonin and Vladimir Pestrikov, partners at the RGD Dispute Resolution Practice, actively contributed to the ISTAW business program. The discussions mostly revolved around the future of international arbitration, including new arbitration techniques, evolving perspectives, and best practices of international arbitration in the new reality.

During the session titled “International Legal System: Restructuring”, Yuri Makhonin delivered a speech exploring the topics of secondary liability and bankruptcy of foreign companies in Russia. He provided insights into the key characteristics of secondary liability as an institution in Russia and discussed the latest trends in its development and its connection with bankruptcy procedures. In addition, Yuri highlighted the influence of the institutional framework of Russian legislation and external factors on the development of these legal fields in recent years.

Vladimir Pestrikov shared his expertise at the session titled “The Future of Construction Disputes: Lessons to be Learned from the Past”. His speech focused on the impact of sanctions on the construction market and the resolution of related disputes. Vladimir provided specific examples of typical construction disputes and outlined measures to mitigate the effects of existing and future sanctions. Furthermore, he discussed strategies to overcome challenges in arbitration resulting from sanctions.

ISTAW is an international arbitration event organized by the Energy Disputes Arbitration Center (EDAC). This year’s conference marked the 100th anniversary of the Republic of Türkiye, founded by Mustafa Kemal Atatürk and his companions. The event brought together current arbitrators, members of the academic community, and arbitration practitioners.
