Andrey Chaika

Andrey Chaika is a Junior Associate at RGD’s Dispute Resolution practice.


Andrey is a lawyer experienced in representing Russian and foreign companies operating in various industries, including construction, oil and gas, media and many others. He focused on Russian litigation and international commercial arbitration, including under the rules of the International Chamber of Commerce (ICC), the Arbitration Institute of the Stockholm Chamber of Commerce (SCC), the London Court of International Arbitration (LCIA), the London Maritime Arbitrators Association (LMAA), the United Nations Commission on International Trade Law (UNCITRAL), and the ICAC of the Russian Chamber of Commerce and Industry. Andrey also has experience in preparing legal reports on Russian law issues for Dutch, English and US courts, as well as international arbitral tribunals.

Andrey’s academic interests include private international law and international civil procedure. He is also a coach for winning team and finalists of major Russian moot courts.

 

Background


Prior to joining the RGD team, Andrey worked for several years at a prominent Russian law firm, as well as at a legal boutique focusing on litigation and international arbitration.

International commercial arbitration


  • Participation in a project for representing a minority shareholder in arbitration proceedings under LCIA rules to recover approximately USD 500 million in damages for failure to distribute dividends

  • Participation in a project for representing a UAE supplier in a multi-contract arbitration under UNCITRAL rules to recover debts in excess of USD 500 million

  • Participation in a project for representing a Russian state corporation in a multi-billion dollar arbitration under ICC rules arising out of the termination of an EPC contract

  • Participation in a project for representing an international company in a major arbitration under SCC rules arising out of the termination of wind farm construction contracts

  • Participation in a project for representing a marine vessels buyer in an arbitration under LMAA rules for recovery of damages in connection with termination of contracts due to the sanctions imposed

  • Participation in a project for representing a foreign company in a major dispute under the rules of the ICAC at the Chamber of Commerce and Industry of the Russian Federation concerning the performance of option agreements on the alienation of shares. The case was one of the first in modern Russia where the joinder of a third party to arbitration proceedings was initiated

  • Participation in a project for representing a foreign company in Russian commercial courts in connection with the enforcement of an arbitral award

  • Participation in a project for representing a shareholder of one of Europe’s largest chemical plants in a dispute concerning a challenge to its privatisation procedure

  • Participation in a project for representing a major Russian media in a dispute over an oil company’s claim for protection of goodwill and recovery of RUB 500 million as compensation for damage to goodwill

  • Participation in a project for representing a major Dutch bank in a Russian bankruptcy case and further debt collection procedures

  • Participation in the preparation of an expert report for a Dutch court in a major dispute concerning the foreclosure of a Russian company’s trademarks by former Yukos shareholders

  • Participation in the preparation of an expert report for a US court in a dispute to recover damages for the alienation of software developed by Russian programmers. The total amount of the claim was over USD 500 million


Pro Bono


  • Participation in a project for representing the interests of a Russian citizen in connection with an application to the Constitutional Court of the Russian Federation on the issue of violation of his rights by the legislation on social security
