Georgiy Kandelaki

Georgiy Kandelaki is a Senior Associate at RGD’s Dispute Resolution Practice. Georgiy specialises on settlement of problem debts of Russian companies under international sanctions in foreign jurisdictions, as well as on complex cross-border litigation in commercial disputes in Russian courts and in international arbitration. Georgiy is experienced in advising on the recognition and enforcement of Russian judgments abroad in terms of sanctions, as well as in conducting complex legal due diligence of the largest holding structures in determining the directions of potential asset dissipation, and in internal investigations.


Background


Prior to joining the RGD team, Georgy worked in the Legal Department of the State Bank. His competence included actioning on behalf of the company in the largest cross-border and Russian litigations of the State Bank Group to recover distressed debts in terms of internation sanctions.

INTERNATIONAL DISPUTES AND ARBITRATION


  • Representing a state bank in a fraud lawsuit in Cyprus against the world's largest ilmenite supplier in the context of the prosecution of the debtor by US partners.

  • Representing a state bank in obtaining a worldwide freezing order in support of Russian litigation, and arbitration in the LCIA.

  • Representing a state bank in Hong Kong International arbitration court in a dispute with a foreign financial institution on invalidating of an agreement on the settlement of transactions, protection from the antisuit injunction on Russian lawsuits.

  • Advising a Russian gold mining company in litigation (RICO) in New York, USA against a former director and shareholder of the company.

  • Advising the largest creditor in the arbitration proceedings in the LCIA against Cyprus holding company and its guarantor.

  • Advising the largest creditor during the bankruptcy of a holding company which owns a number of real estates in Turkey.

  • Representing a state bank in the bankruptcy of a Cyprus holding, change of control over the company and subsequent prosecution of beneficiaries.

 

CROSS-BORDER DISPUTES AND RUSSIAN LITIGATION


  • Representation of a state sub-sanction bank for debt collection from a foreign financial institution in accordance with the exclusive jurisdiction of Russian courts in disputes related to sanctions, in the context of an antisuit injunction against Russian lawsuits.

  • Representing of the largest creditor in the cross-border bankruptcy procedure of an international industrial holding (titanium, ilmenite) in terms of sanctions.

  • Representing a large construction holding during its bankruptcy proceedings.

 

CORPORATE PRACTICE


  • Advising a BVI-listed holding company in the process of delisting from the Canadian Exchange (TSX, NEX).

  • Conclusion of a deal of claim rights acquisition in several jurisdictions against with an obligation to transfer the debtor's assets to the counterparty in the future.

  • Advising a state corporation in the assets consolidation process through a series of mergers and acquisitions, as well as in the bankruptcy of debtors.

  • Corporate investigation, identification of facts of asset withdrawal from fintech companies.
